UPDATE - May 7, 2006
Respiratory Therapists in Pennsylvania continue to wait along with the PSRC for the final regulations from the PA Board of Medicine in regards to the continuing education requirement. PSRC President John Conrad once again provided the recommendations of the PSRC leadership by suggesting to the Board of Medicine that they should allow a blend of traditional (i.e. seminar, lectures, etc.) and non-traditional (internet, journal, CD-ROM, etc.) forms of education to satisfy the continuing education requirement. Our most recent communication with the board and counsel indicates that they accepted our recommendations favorably and are considering this for final determination of the continuing education requirements. However, until the final regulations are published the PSRC continues to recommend that all therapists continue obtaining their necessary continuing education hours from "live" events only.
Respiratory Therapists are encouraged to keep abreast of changes by continuing to monitor the PSRC website as any new information will be immediately communicated via the website. UPDATE - February 16, 2006
As the regulation process continues to move along, the PSRC has become aware of a number of rumors that are floating around regarding the status of the regulations. Here now is a list that separates the rumors and the facts! Any questions you have regarding this ongoing process can be emailed to the PSRC Legislative Committee Chair (Garry Kauffman) at 2006Legislativechair@psrc.net
1) RUMOR: The PA Board Of Medicine and the PA House Professional Licensure Committee have already decided our Continuing Education requirement issue.
FACT: As of 02/16/2006, the continuing education issue has not been resolved in either the PA BOARD OF MEDICINE, THE PA OSTEOPATHIC BOARD, OR THE PA HOUSE PROFESSIONAL LICENSURE COMMITTEE.
2) RUMOR: Our continuing education requirements will be pro-rated so that we only need 10 Continuing education units ending Dec. 31, 2006, in order to renew our certificate.
FACT: Discussion took place at a recent Board of Medicine meeting regarding this topic and the general concensus was that RT's were notified last June that 20 hours of continuing education will be required prior to December 31, 2006, and that this was more than enough notice for this requirement to be met. Therefore pro-rating of continuing education requirements was not a consideration. .
3) RUMOR: The recommendation from the BOM is that Continuing Education Requirements will be split into 10 live and 10 non-traditional.
FACT: As of 02/16/2006, the BOM has not sent any recommendations regarding respiratory care continuing education requirements to the PA House Professional Licensure Committee. During the comment period that followed the initial publication of the regulations, the PSRC recommended that at least 1/2 of the continuing education requirement be accepted by non-traditional sources (i.e. the internet, professional journals, etc.). The Board of Medicine was not opposed to this recommendation and has agreed to consider a combination of live and non-traditional continuing education. However, no definitive numbers have been established and until the final regulations are published, it is recommended that RT's continue to complete continuing education through LIVE events only.
4) RUMOR: The PSRC is making the decisions regarding continuing education for RT's.
FACT: The PSRC has no control over the regulations regarding continuing education other than to offer advice to the PA State Board of Medicine and the PA State Board of Osteopathic Medicine. The content of the regulations is the responsibility of these two bodies and NOT the PSRC.

UPDATE - December 12, 2005
- The commend period has ended for the proposed regulations and the PSRC's recommended changes to the proposed regulations were submitted. The regulations were sent to the House of Representatives who, in turn, referred them back to the State Boards of Medicine and Osteopathic Medicine for clarification. All comments received will now be reviewed by the respective Boards and changes can be made to address those comments should the Board approve. The regulations will then be sent back to the House of Representatives for approval.

UPDATE - October 17, 2005
- PSRC Legislative Committee Chair John Conrad along with committee members Gary Kauffman and Tom Lamphere met with members of the PA State Board of Medicine on September 28, 2005. The main purpose of the meeting was to review the PSRC's request that the PA State Board of Medicine broaden their interpretation of the new law that now governs continuing education for Respiratory Therapists in the state. Specifically, the PSRC requested that the Board's interpretation of the new law include non-traditional types of continuing education (internet courses, journals, etc.). After learning that potential obstacles to the passage of the new regulations may include the lack of any requirement for courses on Patient Safety or Ethics, the PSRC also recommended that one hour of the continuing education course be mandated for each of these topics.
- The PSRC presented several documents supporting their request including letters from the AARC and PSRC Presidents, the results of a PSRC survey of RT department managers across the state, research articles supporting the use of internet education, and the results of a survey of other state laws.
- After a discussion on various aspects of the request, a general consensus was achieved that 50/50 split of traditional versus non-traditional programs is appropriate. This would allow for 10 hours of the mandatory requirement of 20 hours to be completed via non-traditional routes.
- Although a general consensus was reached that would allow non-traditional forms of continuing education, the regulatory process is still ongoing and has several more steps (including passage by the PA House of Representatives) before the final regulations are published. Therefore, the PSRC and PA State Board of Medicine continue to recommend that any therapist who wishes to complete some or all of their continuing education hours do so at LIVE events that are approved for continuing education by the AARC, AMA (category I), AOA, or CSRT until final regulations are published that allow non-traditional forms of continuing education.

UPDATE - September 10, 2005
- The PSRC Legislative Affairs Committee has completed a survey of Respiratory Care department managers regarding the new continuing education law. The results of this survey will be presented to the PA State Board of Medicine along with several other documents (including a strong letter from AARC President John Hiser) supporting the PSRC's request to broaden the interpretation of the new law to include non-traditional types of continuing education. Non-traditional education includes internet courses, journals, etc. .
- Keep an eye on the PSRC website as we have been informed that the process of finalizing the regulations for the new law continues to move forward. Watch for an update later this month!

UPDATE - July 27, 2005
- The PA State Board of Medicine met on Tuesday, July 26, 2005. The proposed regulations were approved by the Deputy Secretary and sent to the Office of General Counsel. This is just one of a number of steps in the process of publishing the final regulations regarding the new law that requires 20 hours of continuing education for Respiratory Therapists every 2 years. Once all of the necessary steps are completed (which includes approval by the PA House of Representatives), the rules will be published and a 30-day comment period will begin.
- A letter and survey from the PSRC Legislative Committee has been mailed to hospital Respiratory Care department managers. The information gathered from this survey will be used along with a great deal of other information to provide what the PSRC hopes is thoroughly convincing rationale for the Board of Medicine to change their interpretation of the law to INCLUDE non-traditional forms of continuing education, including on-line courses, journals and more. If you are a manager of a Respiratory Care department (in a hospital or any other type of facility) and did not receive a survey, simply email John Conrad at 1Legislative@psrc.net and request a survey.
- The PA Board of Medicine does not meet in August, therefore another update will not appear until September, 2005

- June 21, 2005 -
- A letter has been sent (dated June 14, 2005) to all RT's licensed by the PA State Board of Medicine regarding the new law that mandates continuing education for Respiratory Care practitioners in Pennsylvania. This letter is NOT the final ruling regarding the final rules for this new requirement! Instead, this letter was sent to insure all RT's are aware of the new law. The information presented below is still accurate and the PSRC awaits the 30 day comment period after the publishing of the "Rules and Regulations" regarding the new law. The timetable of when these regulations will be published is still not known, however, an update will be posted on the PSRC website once it is known.
- The PSRC has been informed by the lawyers for the PA State Board of Medicine that their current interpretation of the new law that mandates continuing education for RT's will include a requirement that continuing education credits be from "live" events only. The reason for this interpretation is that the law states "...certificate holders shall be required to attend and complete 20 hours of mandatory continuing education during each two-year certificate period."
- The PSRC is staunchly opposed to this interpretation as it exlcudes non-traditional continuing education formats including those offered via the internet, CD-ROMS and the Respiratory Care journals. The PSRC Legislative Committee has been in contact with the lawyers and is currently collecting information to present to both the State Board of Medicine and the Osteopathic Board of Medicine during the 30 day comment period that will follow publication of the new regulations. This information will contain important facts from numerous sources that will demonstrate the necessity for non-traditional programs as well as their credibility to meet the intent of continuing education. As part of this gathering of information, the PSRC will be mailing a letter & questionairre to RT department managers. The managers will be asked to respond directly to the PSRC so that an organized document can be presented to the State Board of Medicine and Osteopathic Board of Medicine.
- The PSRC has also been told that the regulations will not be completed until at least the end of the summer. The regulation process is extremely long and requires input and approval of numerous government offices and officials including the House of Representatives. As an example of this process, think of the regulations as a new piece of expensive respiratory equipment that you want for your facility. Now think about how many people have to sign off on that equipment before it actually arrives in your facility!
SUMMARY: Here's what we know as of today, June 21, 2005:
1. All Respiratory Therapists in the state of Pennsylvania are required to
complete 20 hours of continuing education from an approved provider by
December 31, 2006.
2. The accredited providers that will be accepted as of today include the
following:
American Medical Association (AMA) - category I only
American Association for Respiratory Care (AARC)
American Osteopathic Association (AOA)
Canadian Society of Respiratory Therapists (CSRT).
3. In addition, advanced course work in respiratory care successfully completed
at an institution of higher learning which offers academic credits will also
qualify. Courses in office management will not qualify.
4. Qualifying courses must be from traditional (live) sources.
5. The time frame for completion of the regulations is difficult to establish due to
the complexities of the regulation process. However, the process will most likely NOT be completed prior to the end of this summer.
